Basically under what charges can they get an immigration hold on you?

  1. Well, in Phoenix, AZ being a Brown Hispanic is grounds for an immigration hold regardless if you're a citizen with a criminal record or not.

    Paul Chagolla, Correa was stopped about 10 p.m. January 18 because he was driving without his headlights on. The MCSO actually arrested Correa for failure to show ID, even though the report written by deputy C.A. Rangel notes Correa eventually produced a valid Arizona driver's license, just not quickly enough to satisfy Rangel.

    Correa wasn't ticketed for driving sans headlights. Instead, he was ticketed for not showing ID, which he, in fact, produced. For not having insurance, which he has. And for not having his registration in the vehicle, though MCSO ran the car's plate, and found the registration was legit.

    MCSO confiscated Correa's valid state driver's license, and on Rangel's report is Correa's valid Social Security number. So, why did deputies place an immigration hold on him?


  2. when the authorities takes u to jail and ur not citizen then hold will be placed for 48 hrs til INS come n pick u up.if not they have to let u loose..

  3. ANY CHARGE, IF YOU ARE ILLEGAL.  

    Being illegal, you are already a criminal.  They stop you for any reason and find that you are illegal, then you can be held.

  4. All felonys and all convictions newer than 10 years.

  5. Crimes of Moral Turpitude, such as drug distribution, human trafficking, prostitution, murder, assault, illegal weapon possession etc.

    Also, terrorism, espionage, threat to public safety or the government, visa fraud, forgery of document, misrepresentation of documents to obtain green card etc. Any other federal crimes could cause immigrant's detainment and could cause deportation.  

  6. Any charges, even a traffic stop can result in an immigration hold.  The hold is not for the crime, it's for not having a valid document (visa) granting a foreign person permission to be in the United States.

    The immigration hold is to make sure the person does not run off before deportation proceedings can get brought against him/her.
