heres what he does. stays at a toy store after its closing time comes out of a hiding place in the store at midnight goes behind a counter prys open a cash register and steals money from the cash register

Each state defines the crimes differently.  In NJ, you could be charged with burglary, which is the unlawful presence with intent to commit a crime, as well as larceny, which is the actual taking.
