What do I do if Im offered another job that I want if Im out on short term disability?

Do I just keep collecting until I start the new job??Thanks.

  1. This will depend upon who is paying you short term disability benefits.

    Five states pay workers benefits when they can't work (Hawaii, California, New York, New Jersey and Rhode Island) due to a temporary disability. In those states, you can continue to collect benefits until you are able to work, regardless of employer.

    If the short term disability benefits are paid by your current employer, be cautious. Some companies specify that if you do not return to work after the disability, you may have to pay back all the short term benefits that you have collected.

    If you are being paid short term disability benefits by an insurance company, check the policy. Some companies will continue to pay benefits until you can work, regardless of employer.  


  2. You are obviously not allowed a duplication of benefits or wages for the same time period.  That would be illegal.

    Do you actually have the job, or, are you certain to be hired?  You don't want to stop the disability if there is any uncertainty about the new employment.  Also, does the new employment involve tasks that you are currently disabled from performing?  If so, do not accept the new employment.

    if you are medically able to do the new job, and you wish to accept it, once you are hired, then you have the obligation to advise the payor of short term disability of your new employment.
