What do I do if my employere does not pay me?

I have worked at a home improvement company for over 5 weeks, my first paycheck was returned, and the second paycheck was not recieved. 4 other coworkers also did not recieve the second paycheck. My employer has told me that I will receive the checks several times, but I have not gotten them. What can I legally do?

  1. file a grievance with the labor board in your area. Personally I would get out & find another job


  2. In California you can file a wage claim with the Department of Industrial relations. On their Web page go to Labor Law - Wages

    A wage claim may earn you as much as a full days wages for each day you employer withholds your pay. I once filed a claim on my home improvement employer and was awarded $1,380 penaties.

    What state are you in? Most states should have similar departments to guarantee your rights to your wages.

  5. Give your employer one more chance. Go to the office. Tell them again what they owe you. Tell them you're willing to pick up your check right now, on the spot, while you are standing there in their office, and you will forget the whole thing. Don't take "the check is in the mail" for an answer. They need to cut you a check on the spot. Tell them that the alternative, if they don't cut a check, is that you will go to the department of labor in your state. Then leave, and go straight to the DOL. The DOL will take this very seriously.

    Be prepared to find a new job though. Your employer will resent you. But you need to find a new job anyway, as you employer is both unethical and probably about to file bankruptcy.
