What do SA,Texas independent insurance agents do if your FMO,GA-General Agent wont pay your commissions?

How do companies appoint GA's,FMO's? If you want to switch GA or FMO what are the rules? My GA has taken a different position and wants to place ind. agents under him to the FMO he has chosen. Without giving us a choice. Our ind. agent contract is only with the GA and no FMO was ever named. Our GA has released us to work with another company but now states that the letter he signed is invalid because his FMO is not releasing anyone. We have asked to meet him but he is never in town and hard to get in touch with. There are many rumors that it is hard to get paid for commissions by him. So we'd like to switch to a GA with another company who also writes Medicare Advantage plans. What kind of attorney represents ins. agents? Any help is greatly appreaciated.

  1. You have a lot of ? I don't have the answers to - but I would start by calling Lawyer Referral and with an attorney's help, commencing with a lawsuit - this is RIDICULOUS!! Power to the underdogs!


  2. You need to contact Bogdon Rentea in Austin.  He is an attorney that is VERY knowledgeable in agency contracts. He should be able to advise you and help you with your needs.

    Keep in mind - if you ARE in "independent" agent - you should be able to get contracts on a DIRECT basis with different companies and not be held up by a local GA.
