What do i do if i have missed the day i was supposed to go to court?

i was supposed to be in court on the 7th of last month, but through some mix up i was sure it was supposed to be this month. it was a very minor offence i was going to plead not guilty for and now i am not sure what is going to happen.

  1. call the district attorney's office and tell them what happened. right now you probably have a bench warrant on you. they will cancel the warrant and give you another court date


  2. The judge most probably issued a warrant from the bench for you failing to appear.  If you dare run a stop light, stop sign, etc, they will run you and find out that you have the warrant.  Since a warrant is an order from the judge they will have to lock you up.

  4. Good for you that you want to take care of it no matter what the reason. Do not go to the police/sheriff station. They will clear your warrant by arresting you. (we do that all the time)

    Go down to the courthouse and ask to be put on the court calender.

    Couple of things though.

    At your court date you may be remanded into custody, be ready for that. On the other hand you did make a new date and went to court, most judges look well on that.

    The marshals/bailiffs office may have a policy to arrest if the clerk notifies them (we do not arrest if your doing the right thing by making a court date, some agencies do)

    You may need to post bail up front, be ready

    The warrant remains active until the court date, be careful and dont get stopped.

    If the warrant is recalled by the judge on your court date... KEEP A COPY OF THAT FORM. It will take up to two days for the warrant to be pulled from "the system"

    Just contact the courthouse and explain what happened. If you are upfront and contact them before they contact you, you won't look like you've purposely haven't gone... It's highly unlikely that a warrant will be placed on your details. (If it's not that serious)

    As I said, just give them a call and let them know, and make sure you ask for them to reschedule it for you.

  10. You go to the police and explain, otherwise you will get either a fine or some jail time for missing your court date.

    You HAVE to go down there, or it can get much worse. Mix-ups happen. It's a fact. You have a better chance by explaining yourself and turning yourself in than waiting for them to find and arrest you.

  11. OK, here in Australia each state is a little bit different, but here is a rundown of the usual options.

    1  A warrant may have been issued, even for a minor offence.  If you were on bail, it almost certainly would have been issued.  This warrant will either allow the police to give you bail, or will require you to be taken before a magistrate to get bail, depending on the order made by the magistrate on the day you did not appear.

    You should hand yourself in on the warrant, as it is always makes the bail application easier than if you are arrested on the warrant.  Here in South Australia you do that by going to the police station and saying "I've got a warrant." They then arrest you on the warrant, and either give you bail to another date in court if the warrant allows them to do that, or they hold you in the cells, until you are taken up to Court to appear before a Magistrate for a bail application.

    2  You may have been convicted in your absence.  In these cases, either a penalty might be imposed on the day, and you will get a penalty notice, or a notice may be sent for you to appear on another date for penalty to be imposed.

    You would then need to file an application in the Court to set aside the conviction, as you wish to plead not guilty.  Here in SA, you may be required to convice the Magistrate that you have an arguable defence before an 'ex parte' conviction is set aside.

    Your starting point is to call the Courts call centre and find out what happened on the day you were meant to appear and then take it from there.

  13. A default warrant will be issued for your arrest.  Just go to court and clear it up, they won't arrest you at the courthouse they will just set up another hearing date.  Otherwise if you get pulled over for a very minor offense the warrant will show up and you will be placed under arrest.
