  1. EDIT:  You can try and contact INS at 1-800-375-5283.  They will tell you everything you will need as far as getting your baby across and back into the U.S.

Also, the link I  have provided below gives you detailed info about what is necessary in regards to what is needed to have your baby be allowed to get into Mexico and then back to the U.S.  Read it carefully.

Check out this link.  Ihttp://www.babycenter.com/400_does-my-ba...  If you can get sole custody of the child, you'll have a better chance of getting the necessary documentation.

There is a "special circumstance area" that you can fill in stating why the father can't be there.

This doesn't mean the father will lose custody and it doesn't mean you're filing for divorce.  What you can prove is that you are providing sole monetary support for the child.  I'm not saying that the way the others have said (using DHL) isn't a great idea.  If that way works, then I say try it first.  If that way doesn't work, try what I have suggested.

Check out the last link I have provided in regards to passports.  If you fly, you need passports for you and your child.  If you drive, walk or go by cruise liner, the answer is no you don't.

Contact Senator Leahy (since there is a link in the last link I have provided that shows what he has proposed) to get the correct answer.  http://leahy.senate.gov/press/200706/061...

The following information is from the government website.

If you decide upon traveling to Mexico and come back before the start of next year, all you need is your driver's license (unless you go by flying, I do believe you will need a passport).

Once the New Year kicks in, the following information is what you will need. You will be able to use a Trusted Traveler Card or a passport to re-enter the U.S. (if you plan on staying into the summer months of 2008).

If you come back before the summer of 2008, here is what you will need:

    JANUARY 31, 2008

U.S. and Canadian citizens will need to present either a WHTI-compliant document (Western Hemisphere Travel Initiative), or a government-issued photo ID, such as a driver’s license, plus proof of citizenship, such as a birth certificate. DHS also proposes to begin alternative procedures for U.S. and Canadian children at that time.

If you come back during the summer of 2008 (at a time to be determined by the DHS), you will need the following (and passports won't be the only method by which you can re-enter the U.S.)

    SUMMER 2008

At a later date, to be determined, the departments will implement the full requirements of the land and sea phase of WHTI. The proposed rules require most U.S. citizens entering the United States at sea or land ports of entry to have either a U.S. passport; a U.S. passport card; a trusted traveler card such as NEXUS, FAST, or SENTRI; a valid Merchant Mariner Document (MMD) when traveling in conjunction with official maritime business; or a valid U.S. Military identification card when traveling on official orders.

The implementation date will be determined based on a number of factors, including the progress of actions undertaken by the Department of Homeland Security to implement the WHTI requirements and the availability of WHTI compliant documents on both sides of the border. DHS and DOS expect the date of full WHTI implementation to be in the summer of 2008. The precise implementation date will be formally announced with at least 60 days notice.

  2. You and the child must have passports to FLY to Mexico.  You do not need passports to travel to Mexico by LAND until after SUMMER 2008...but if you go and want to return after next summer, you will need the passports.  You also MUST have a signed, notarized letter from the father to take the child out of the U.S. and into Mexico.  You need to send a letter to the father by FED-EX or DHL , he can  sign it and have it notarized, and return it to you the same way. If you send it by regular mail it will take months and he may never get it.

  3. I'm the same situation... Here's what I did.

I went to the Post Office to get our baby's passport and explained to the agent that his father is in Mexico. They allowed me to get a passport for the baby without requiring anything from the father.

In case you're not so lucky, you should try to get a letter from him notarized in Mexico explaining the situation. He can write the letter himself and have it notarized in Mexico, then have him send it to you.

(If you need to send something to Mexico, use DHL. It's more expensive than regular mail, but is very reliable and fast.)

If you're looking to travel to Mexico without a passport, you should be able to do so for now if you're traveling by land (not flying or on a ship). There's no problem to enter Mexico. To come back, you'll need to show the baby's birth certificate and your passport/U.S. identification.

On a side note, I'd been told awhile ago that in order to travel without my oldest son (I'm divorced from his father), I'd need to show proof that I have sole custody or a letter from the father granting permission for me to travel with our boy. I've always carried the court order with me, but no one has ever asked to see it.

  4. Your child can travel on your passport.
