What do title companies search for if I am buying a new built home from a builder?

Do they just handle everything? Or do they do searches on the buyers to see if they are married, divorced, etc.?

  1. They also make sure the title is clean (no liens) and that all documents (deeds etc.) are filed with the county.


  2. Title search is limited to the history of the property prior to the closing.  The point is to determine if the seller is conveying good clear marketable title to the buyer. The don't do anything with respect to you, the buyer, and your status in the chain of title only becomes relevant when you sell or encumber the property later.

    As the buyer, you need to know that ordinary title insurance only benefits the mortgage lender.  If you want to make sure your equity in the property is covered for contingencies (for example, a forged signature in a deed) you need to purchase owner's title insurance.  It is quite inexpensive, and usually a good idea to purchase.
