What do you consider to be the most unfair law in the United States?

For me, it's the seatbelt law which says that you can be ticketed if found not wearing your seatbelt. Now I agree that you should be required to make sure that your underage children are buckled in securely, but I really disagree with being told that I have to wear a seatbelt or pay a fine when I may only be risking my "own" life.

  1. Any laws criminalizing the possession of Marijuana for Medical or personal use.

    Not wearing a seat belt does effect others as it tends to cause increases in insurance and medical costs for everyone. Think about it.

  3. Uniform Defense of Marriage Act.

    This places a religious definition and obligation on society. Not every member of society is religious or is of a religion that defines marriage under such strict rules. It places an unnecessary burden on children born out of wedlock by stigmatizing them. (it isn't the kid's fault)

  5. The law where if someone breaks into your house and trips on something they can sue the people that live there.

  6. You might be right about that.  Or helmet laws for motorcycles.  I think it's drug laws, how sentences have gone way out of proportion for 'casual' drug use.  And the huge disparity between powder cocaine and crack cocaine, only because crack is used more by black people.

  9. The attractive nuisance law:  you have to make your property safe for trespassers under 18, if they get hurt while trespassing you are responsible for their medical expenses.

I think that it's unfair that you are guilty until proven innocent in this country.  Anybody can go get a warrant on anybody and not have any proof and that person has to go to jail for something they didn't even do.  That's bull and then it goes on their record as an arrest even if it gets dismissed and then it's hard to find a good job because almost every employer does a criminal background check.  

    Oh and this is for Jen.  I used to be an insurance agent and what you said is not true.  If someone breaks in your house and trips over something, the insurance will not pay for that.

I could agree with your pick of seatbelt laws.  I am old enough to remember when the legislatures made the sales pitch that sealbelt would not be a stoppable offense.  Well, after the law was passed and settled into as "the law" it was made an independent offense.  I am more angered by the lowering of the BAC to .08 for making a presumptive case for drunk driving.  I am not sure a petite woman or even a smaller man could pass the breath test after ONE BEER.  I have not had a drink in 24 years and know that the .08 BAC test is not reasonable to establish drunk driving.  But, your "most unfair law" is darn close.  We have a bunch of police who are just looking a kid to arrest for a traffic code violation.  Seatbelt:  I think 19 year old girls are a prime target group by our "public servants."
