My ex has custody of our children, but he doesn't want to raise them. Right now, my children are living with my ex husband's mother. He lives in one state and my childen lives in another. I am doing very well. I have the home and a great job. Would it be difficult for me to regain custody of my children?

  1. I would get a lawyer - but first document his address, the children's address and the fact that his mother has the kids. Take that with you to the lawyer.

  2. Looking at why the ex has custody in the first place, you gave no details. But if your circumstances have changed and you are in a better place to raise your children, then hired yourself a good lawyer and file for full custody along with all your documentations and raise your concerns about his mother raising the children and living with her and in another state.

  3. I think it would be easy to get them back if he's not taking care of them.

But your question as to what to do when a father doesn't want to raise hischildren - my answer would be to kick yourself in the butt because YOU picked him to be the father of your children!!!

  4. I would think it would depend on why you didn't have custody in the first place.  This is going to be a lawyer question. Some lawyers will consultate for free, some charge. Good Luck

  5. That's okay if he does not want raise his and your children, as long he is still paying child support.
