What do you do when the party at fault does not contact their insurance company to report the accident?

On July 4,2008 I was driving down a main road. A car pulled out of a stop sign to turn left and I was unable to stop in time. The driver was ticketed for failure to yield. She said she was driving her mothers car and the car did in fact have a current policy. The insurance company will not arrange for me to have a rental car, ( I only carry liability because my car is paid off and is almost ten years old) and of course my company will not do any thing either because I do not carry full coverage. The other party, who was at fault, has not made contact with their insurance carrier and the phone number she gave me was not a good number. The insurance company claims to have sent out several letters. I just graduated college and do not begin my new job until the middle of August. I have three children and my husband and I shared that car. He is borrowing a car from his mother or riding to work with people who live by us. What do I need to do?

  1. your insurance company can file the claim for you....provide the accident report to them and they will take care of the rest...it will not go through your insurance....they have access to dmv records and will notify the other insurance company of the claim


  2. Your insurance company will pay for your damages and then go after the other party for subrogation. As for rental car coverage, you will have to pay for the coverage out of pocket but will get reimbursed by the other parties insurance as they damaged your only transportation car. Hope this helps.

Contact your insurance company and let them deal with it.  They are to represent you even if you do not have full coverage.  The other driver was ticketed, there is no disputing who was involved or who was at fault.  If you get nowhere with this, contact your State Insurance Commissioner and ask them what to do.  Generally a call from the Insurance Commissioner's Office gets things going with an insurance co.

  4. you should just need to get a copy of the police report and send it to the other party's insurance company.  that should provide the proof of fault.  however, i don't know that they will give you any reimbursement for a rental car.  if they still don't want to admit fault or write a check, then you should consult an attorney.  once it goes to court, you can sue them for damages & the rental car.
