Question

Davenport Lyons are threatening to issue proceedings against me. Allegedly, my 13-year-old son downloaded a game illegally. I have spoken to him, he didn't know he was doing anything illegal. He didn't install the game and never played it, so he derived no benefit from it. Davenport Lyons are claiming £565 from me. I'm a single mum with two children, now 14 and 4, struggling on benefits. There are no childminders to collect my daughter from school so my employment possibilities are limited. Why do Atari and Davenport Lyons need £565 more than I do? Is this how our legal system is organised? To allow predatory lawyers to trawl through records to persecute a child for a genuine mistake?

To add insult to injury, if I settle out of court and pay the minimum £10 a month they are prepared to accept, the total amount repayable is £656.00. In addition to this, I have to answer a detailed questionnaire and provide them with a statement of means to prove that I cannot afford their original, and in my opinion, extortionate, claim.

I felt that this should be brought to the attention of the public, don't you agree?

get a solicitors advice if you are on benefits you get advice for free,

you can choose any solicitors you like.

ok look this is just a scam. their point is to say pointless. its like the letters people were getting saying they won lotto money and had to pay 1000 to 10000 just to get the 10,000,000

check the I.P address that they say is yours and i most likely wont be. then you know it is a scam. then if you know your son did not download anything go to the police and the citazines advice and talk to them.

just a note of advice if your son is downloading and you have the softwear on the computer take it off as this is illigal anyway. i do downloadmy self using bittorrent as i think the movie monguls charge too much for a cinema ticket (here 10 euro) my way of thinking is if the movie was good enough i delete the movie and then buy the dvd so in the end they really dont lose do they???

anyway in short you dont have to worry as your not going to be sued once you go to the police and report them about the obviouse scam

Tell them you will see them in court.

They dont have a chance of winning due to lack of admissable evidence.  Anyone could have been using that computer at the time and children can't be fined by the court.

They know this and won't want to expose themselves to the potential legal costs of losing the case.

Unfortunately its backed by our Police state (Government) so you have not much chance of being protected by the state that has been bought by the corporate machine that never makes an mistake.
