What do you think about personal searches in school?

i dissagree. Staff of your school should nto be able to touch you in anyway. You could have something very privite to yourself and by teachers and staff going thorugh it, it would violate your privicy. A STAFF MEBER OF YOUR SCHOOL SHOULD NEVER HAVE THE RIGHT TO GO THROUGH YOUR PURSE!

  1. what if their was resonable suspicion of someone carrying a gun?

    Schools currently have the right to search someone if the search is based on fact or a WELL FOUNDED RUMOR as in multiple reliable witnesses.

    I think schools should have every right to do that, say a school didn't search someone and someone got shot in school. The school would blamed for not protecting the kids when even if they did search someone they would still be to blame because they didn't have the right to do it.


  2. The Constitution of the United States provides for protection against unreasonable searches and seizures. This is why there is a thing called a search warrant, which requires probable cause (evidence of wrong doing) to get one. However this usually only applies to private property that you own or rent (home, car, storage bin,etc.) and not to personal searches done in public. Public searches are almost alway considered reasonable because; a) evidence you carry on you can be disposed of quickly, any delay of a search could mean the loss of evidence, and b) weapons could pose an immediate threat to the safety of others. In other words, the only way to catch the bad guy before he does something is to allow the search. As for your locker, that is owned by the school and they loan it to you as a convenience. School is a public place so legally once you enter there you forfeit any expectation of privacy. On the flip side, they cannot take from you anything your allowed to have, and if they don't find anything illegal they must let you go.

  4. I dont' think that it's fair either. There are other areas in peoples lives where it doesn't pertain to their education or employement. Thats interfering in their private lives.

  5. I only believe in searches if they have reasonable cause to do so, for example, reports that a student may be carrying a weapon. But as far as random searches, for example, opening everyone's lockers while they're in classes....that's not cool.

    It is an accepted legal fact, if not an openly stated one, that only citizens of voting age have civil rights.  Respecting the rpivacy of school-age children is merly a courtesy, not an obligation.

    Yes, it sucks.  No, there is nothing wrong about it, in the legal sense of the word at least.

    My advice, have fun with it.  Hide thigns that seem suspicious, but are perfectly innocent all over.  Strap a sharpie marker to your leg with duct tape.  It will drive them nuts, but they won't be able to punich you for anything.

    What would they put on the write-up?  "Too well-supplied for class"

  7. Kids in school have no right to privacy.  If you don't want them going through your purse, don't carry one.  The safety of the student body as a whole outweighs the concerns for individual student's privacy.  Too bad.

  8. I agree too. Like the metal detectors aren't good but they're better than someone actually touching you.
