  1. Married persons have the option to file a joint return - tax is less on a joint return that for head of household.

    For an amended return, filll oiut form 1040X and file it

    If someone is married but has been separated since at least June 30 of the tax year, has a dependent child living with them, and provides over half the cost of maintaining the household for that child, that person can file as head of household.


  2. A married person can file as head of household if they meet certain conditions. You can find these in IRS publication 17, page 22-23

    If you already filed a joint return, you cannot amend the return to any other status after April 15.

  3. The IRS has specific regulations classifying the filing status of taxpayers.

    The following is what the IRS says is the definition of Head of Household:

    Head of Household Generally, you may claim head of household filing status on your tax return only if you are unmarried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or other qualifying individuals.

  4. If the two spouses are estranged (living in different households from 7/1 to 12/31) and the spouse with children can prove they paid for mroe than half the bills of their household, they can amend from MFS to HOH.  Unless there were children living with them, the other spouse would have to continue to file as MFS.

  5. For head of household, you must be un married or considered unmarried.
