What does Obama mean by 'the terrorist need some form of due process'?

Obama's team said they would give ben Laden access to Habeas Corpus if captured! ben Laden isn't an American Citizen - Why? With the recent Supreme Court ruling, terrorists and all those captured in war, now have their fate laid in the hands of the lower courts. Has America gone mad?

  2. Habeus Corpus was also used during the Nuremberg Trials of n**i war criminals. They were tried, convicted and some were sentenced to death and others to long prison terms. Our upholding of our laws was a shining beacon and said that this country stood for something and was the envy of the world. Once you decide to ignore rules of law, then this country becomes no better than some of those 3rd world countries we love to chastize

The whole basis of our law, inherited from England, going back to the Magna Carta and even some principles of ancient Greek and Roman law, is that a person accused of a crime is innocent until proven guilty.  That doesn't mean he can't be imprisoned, tried fairly, punished, even executed.  It just means that he has certain rights.

    If I accused you of stealing from me, the burden of proof would be on me to prove that you did it.  Otherwise you walk.  YOU do not have to prove your innocence.  That's the way it is, and how it should be.

    If we catch Osama, we have a perfect right to imprison him, to gather evidence against him, and to try him.  If he is found guilty, we have the right to punish him.  What more do you want?

    You don't even really know Osama did it!  All you know is what the government tells you.  We heard Osama Bin Laden was behind 9/11 before the smoke had settled.  Then we heard Saddam Hussein had helped him.  That turned out not to be true.

    If we catch Osama (and I think it's a moot point because I don't think we will now), he has a right to a lawyer, to know the charges, to know the evidence against him and to DEFEND himself in any way he can.  If we deny him this right, the rest of the world will take note and will see him as a political prisoner, a victim of political assassination.

    Meanwhile, there's Habeas Corpus.  Osama's lawyer has a right to ask to be provided with the reason Osama is being held, what the charges are against him.  That's all habeas corpus is.  What part of that do you have a problem with?

    We have fought terrorists for years, caught them, tried them, punished them, etc.  We fought the n***s and Tojo, we fought the Brits in our revolution and 1812.  We fought the Indians, the Mexicans, we've fought mass murderers, child molesters, etc.  But we NEVER have found it necessary to suspend Habeas Corpus except briefly during the Civil War, and that was only briefly, and cancelled by the Supreme Court.  So why is it suddenly so all-fired important to do away with our whole system of justice -now-?  Have we gone mad indeed!

  7. I think its far more dangerous in the long run to deny due process to people just because we don't like them. Terrorists are horrible people, don't get me wrong, but, to deny them due process is setting a dangerous precedent.

  9. Habeas Corpus applies (or applied, before Bush did it in) to actions of our government, and it applies whether you are citizen or not, with two very limited exceptions.

    Since you obviously know very little about Habeas Corpus, then let me explain another good reason for due process. (Other than it protects *you* from being detained without hearing, and, given the pending Democratic landslide I should think you might want to protect yourself.)

    It's easy to simply gather up suspects. Any moron with a badge and a gun and a holding cell can do this. Holding them without due process of law means you hold them until they die OR you quietly LET THEM GO, as Bush did for quite a few detainees. Without due process you really have no idea who the moron with the gun has captured or if he captured innocents and lies to you about the peril. Maybe, as Bush did, you let one go who later detonates a bomb against you. In essence, without due process, you are trusting the LYING MORON WITH THE GUN to decide for you, without oversight, whether to keep or release.

    I realize that Bush's judicial system has failed utterly to prosecute and convict those few accused terrorists who did get trials, and that has you frightened. Look beyond the bozo-in-chief and you'll find the US has successfully prosecuted and sentenced many accused terrorists BEFORE Bush.

    Clinton's prosecution of the blind sheik will keep him and his cohort from ever disturbing your slumber.

American is founded on the principles of right to fair and speedy trail, and innocent until guilty.     Additionally, You mentioned "terrorists and all captured in war". " All captured" may not be guilty of anything other than being caught in Iraq.

    Because of the handling of many people who have YET to be charged with a crime, most of the world is beginning to no longer see us as a civilized country.

    Of the 9 members of the Supreme Court, 4 of them were appointed by George W. Bush and of the rest 3 of them were also appointed by Republicans.  2 were appointed by Clinton.

    7 of the 9 members of the Supreme Court are "right wing" Republicans.  How do you attribute their decision to Obama?

    Within the answer released by the Supreme Court appears this line:

    "Neither the President, nor the congress, has the right to cancel portions of the Constitution at will".

    What is really funny is that Tim McVeigh, the Oklahoma City bomber, was captured, tried, convicted, and executed in less time that it has taken Bush to capture Osama.
