What does a person need to enter canada from us, if he/she is not legal resident in us?

hello every one ,

i was wondering what does a person need to have to enter canada and ask for refuge , to stay legal way in canada?

is it ok to cross border with expired california ID and home country passport?(expired as well) thanks in advance!

  1. you can not claim refugee staus in canada as you were in the US first,you should have applied in the US as this was your first safe stop after leaving your home country

    Safe Third Country Agreement

    Under an agreement with the United States, refugee claimants must seek asylum (protection) in the first safe country where they arrive. For example, if you entered Canada at a land border from the United States, you will not be able to claim refugee protection in Canada. Entering into Canada, the first thing they check is whether you were out of status in the US.  If you were out-of-status in the US, there is no way they will admit you.  They hand you over to the Border Patrol, securely handcuffed, right there at the border.  And don't even think about asking for refugee status or asylum, especially if you are coming from a safe third country (the US).  That's fraud.

    So that is assuming you make it to some Canadian checkpoint or official.  However, if you go out through any US border checkpoint, Border Patrol is going to have your guts for garters right then and there.  Expired passport from your home country, expired "ID" from California?  Your new home is prison and/or immigration detention.

    How to extricate yourself from your mess?  Go to your nearest consulate and renew your passport from your home country so you can get back in, get a plane ticket back to your country, go straight to the nearest airport and go home.  ICE may stop you at the airport for lack of legal status in the US, but if you tell them you're illegal and want to return home immediately, you will be on a plane home.  It is the only way to avoid prison and/or immigration detention, and you may get a shorter bar to re-entry than if you are deported.
