What does it take to get the death sentence?

Just wondering. what do they do that is so much more worse than others.

  1. The courts have greatly reduced the crimes that qualify for a death sentence.

    Now most have to murder someone during the  commission of another crime, or get paid to murder someone.

    With the advent of true life in prison without parole it is getting harder for a jury to hand down a death sentence.


  2. What does it take to get the death sentence?  Well, there are many variations of explanations about how one can be convicted and be legally executed, regardless of whether the person really is guilty or not!

    First of all,one must be convicted in a state that still has the death penalty, like Texas more prominently, and most of the states have the death penalty.

    Then theoretically, there has to be a clear and effective case that the murder was committed as an intentionally malicious act.  As for our US government, that has not always been the case, which is why many of us who theoretically might agree with the death penalty in certain rare cases, are now campaigning against the death penalty because it is so barbaric in its application.

    There are several cases of people being executed when their crime was not substantiated by honest facts, and they were later found innocent after their executions.  Sad but true.  But the propensity of the mood is that people must die as a penalty -- allegedly not as a punishment but I think the entire process bespeaks of that being a folly notion -- and there are a lot of pro-and-con arguments going on about that.

  3. The court will look at several mitigating factors in a murder case to determine if the accused should be punished by the death penalty.  Examples of mitigating factors would be murder for hire, the victim was a public official in the performance of his/her appointed duties, the victim was a child, or any other factor that makes the crime especially heinous.  In most states, the jury has to agree to this form of punishment.  I hope this helps.
