Jailbait is a term  that refers to any underage girl who is considered to be legally unable to give consent for any type of sexual contact. If a guy were to have s*x with a "jailbait" he is setting himself up for arrest, prosecution, and possible imprisonment  for statutary rape. It would not matter if the girl agreed or not which is the reason for the term.
