  2. Hello Maria. Some incorrect answers above me here.

    When a person is arrested, they go through a booking process ( pictures, fingerprints,etc.).

    Within a few days ( if the person were  arrested on a Friday night, they would be in arraignment on Monday) a person will be formally charged by a Judge. (This is the arraignment).

    At arraignment, by law, a person is ONLY allowed to plead "Not guilty". If you were to attempt to plead guilty, nolo contendre or guilty with reason, the Judge will not allow it. (This is why you read in the newspapers how a person caught with a smoking gun in their hand at a murder scene just plead "Not Guilty").

    Once the plea is entered, the Judge will raise, set or deny bail. Bail is nothing more than an amount of cash posted by the arrestee (or bondsman) to make sure the person will not flee the jurisidiction and return for trial. In certain very large drug cases, bonds are completely denied, holding the individual until trial because of a reasonable doubt on the part of the court that the person will leave the country.

    Before the trial, a pretrial is held. As noted by one poster above me, this is where a person may plead "nolo contendre" (which means "do with me as you will". It is pleading guilty but not accepting any blame. This is primarily done in a criminal case when the person knows a civil law suit may follow. Nolo Contendre will help to protect them from an admission of guilt in the civil suit. Or the person can enter various other pleas.

    If no plea is entered or accepted, the case continues to an actual trial.
