What does the term "as is" mean in regards to a RENTAL situation?

I just rented a place in Nevada. I am renting a private home through a third party real-estate company. A few days after I moved in, I discovered that the entire carpet smelled like urine. It is so bad that there are rooms I cannot even use in the house. When I complained to the agent, I was told that I rented the place "as is", and that this is in my lease. What do I do now?

  1. That probably means that you have to pay to redo the carpet yourself

    "as is" means they won't help/provide funding for projects around the place


  2. The clause "as is" does not apply when it interferes with the basic living condition.

    THAT IS AN IMPLIED / BASIC RIGHT OF THE LESSEE.

    That holds true even if it is not written in the lease.

    Therefore, you can still do the following :

    1. Get in touch with the landlord or the agent and demand that they clean and / or change the carpet.

    2. You can tell them that you won't pay the rent until that has been done.

    Read the lease carefully though to make sure that they do not have a clause for eviction when you do not pay the rent.

    However, no landlord can evict you until they go through the court to get the eviction order, which takes about 6 months or so.

    3. You can make a strong case if you have asthma.  Talk to the landlord or the real estate agent about your health condition and how the unclean carpet if affecting your health.

    They WILL definitely get it done quick because you can suit the landlord if he does not get it cleaned for you.

    Your case will be even STRONGER if there is any child or pet involved.

    4. You can also take it upon yourself to have the carpet professionally cleaned and then deduct the money from the rent. Just attach the copy of the invoice with the rent check.

    Make sure you inform them of your intention first before you spend out of pocket.

    5. If worse comes to worst, get a lawyer to represent you.

    6. If you are a student, you can go through your university's housing department. They will arrange for legal representation for free.

    1. Next time read the entire lease thoroughly and get ammendments done before you sign anything.

    2. Once the carpet is cleaned make sure it is thoroughly dried. Too much dampness can cause such poor odor. You mentioned that you noticed the smell a few days after moving in. I believe that is what happened in this case.

  3. it means you need to get the carpets cleaned. AS IS means that you are renting the place with all the flaws that it comes with and that the landlord is only responsible for fixing new flaws

  4. "As is" means, just that....they can't make it anymore clear.

    That means that they don't intend to paint, clean or repair.

    You knew that when you rented it.
