What does this mean "MOTION/PENDING CASE" ?

  1. It would help to know what jurisdiction you're talking about, and where you are seeing this onfo (on a file, on a computer?) and in what kind of case (criminal or civil)

    A motion is a request for a judicial order, and includes a legal argument in support of that request (that would either involve relevant court decisions establishing existing precedent or effective statute).  Once the motion has been files, and the other side(s) have responded, it's up to the judge to decide the motion.  Once a motion schedule has been set (a lawyer says he's going to file a motion, but hasn't yet - the judge will issue asome dates indicating when the motion is due, when a response is due when a decision can be expected) or he ahs otherwise served the motion, and until a decision has been made. the motion is pending.


  2. not exactly sure, but a motion is a request made by an attorney to try and get the court to take some action...thats possibly what the pending part means..that the case is pending b/c its waiting for the court to rule on a motion..hope this helps some
