If you havent contacted a guy in about a month and hes sent you flowers, a letter saying hes sorry, and a bear, is this considered stalking?

  1. No, that is not considered stalking.  If he is constantly showing up at your door, or following you around, that IS stalking


  2. That is not even close to stalking. Stalking would be him leaving things on your car in the middle of the night or while you were at work. Stalking would be when you hear something outside your home and he would just be standing there, looking at your apartment. Calling and texting at all hours of the day and night.

    Sounds like he just wants you back.

This includes following the person to certain places, to see where they live or what the person does on a daily basis, it also includes seeking and obtaining the person's personal information in order to contact him or her; e.g. looking for his or her details on computers, electoral rolls, personal files and other material containing the person's private information without his or her consent.

    THESE GUY is considered to be a long lost friend or something which didn't heard or have news before in a long long time. While the opposite of stalking who follow you everywhere you go, except the toilet of course.

    If you didn't heard from him a month back and suddenly send you flowers for reminding you of him and a letter meaning he is returning back FROM THE GRAVE, some kind of ZOMBIE then it is not Stalking per se.

    All crimes are specifically defined in the criminal statutes of each state.  You should be able to find a copy of your state's code in any public library.  In NYS, you will find the law in Article 120, the same aprt that deals with assault and menacing crimes.

No, not really.  Sounds like he is hoping you have a change of heart and give him a second chance.  If he starts following you places, hanging around the place you live, and showing up in your life uninvited....then it could start to be stalking.  Right now, maybe you could just have a talk with him and explain to him how you feel and its over.  This way, if he continue, you can always say that you told him no and he is ignoring your request.

       (f) For the purposes of this section, "course of conduct" means

    two or more acts occurring over a period of time, however short,

    evidencing a continuity of purpose. Constitutionally protected

    activity is not included within the meaning of "course of conduct."

       (g) For the purposes of this section, "credible threat" means a

    verbal or written threat, including that performed through the use of

    an electronic communication device, or a threat implied by a pattern

    of conduct or a combination of verbal, written, or electronically

    communicated statements and conduct, made with the intent to place

    the person that is the target of the threat in reasonable fear for

    his or her safety or the safety of his or her family, and made with

    the apparent ability to carry out the threat so as to cause the

    person who is the target of the threat to reasonably fear for his or

    her safety or the safety of his or her family. It is not necessary to

    prove that the defendant had the intent to actually carry out the

    threat. The present incarceration of a person making the threat shall

    not be a bar to prosecution under this section. Constitutionally

    protected activity is not included within the meaning of "credible

    threat."

    So as far as what you're asking about, not in California.  I would seriously doubt it would qualify as stalking anywhere in the USA, in fact.

  12. Uh NO........stalking is when someone watches you from a distance and follows you know what your doing..definitly far from wat you said he probably likes you its called love.

  13. Stalking would be taking the flowers and slowly removing the leaves, causing the stems to become bare. This can also be done with celery, but that should be done in the food section. I hope this helps.
