What factors differentiate a D.U.I. from a D.W.I.?

  1. they are the same thing, dui is driving under the influence, and dwi is driving while intoxicated. they both mean the same general thing.


  2. I believe that some states call the same thing different names. I would think that it would be the difference in alcoholic content in the blood.

  3. it varies but i believe in a DWI they are generally speaking intoxication of alchohol and DUI as being under any substance that could cause serious harm to others while you are driving a car. even if you wreck on accident you are charged with failure to control operated vehicle

It varies from state to state, but generally, DUI is a less serious charge than DWI.  In some states the difference is the alcohol level.  That's why some folks refuse a breathalyzer - the will get a DUI charge for sure, but a breath test might put them over to the DWI.  In other states, Texas for example, age can make a difference.  If you are under 21 in Texas and have consumed ANY alcohol, you can be charged with a DUI.

  6. DUI is a broader term that can mean under the influence of any substance, ie. drugs, pot, prescription medicines, etc.
