What gives the United States Supreme Court their authority?

  1.   In the Constitution it is Article lll of the Constitution. The Supreme

      Court of the United States is THE only court mentioned, by name in

      the Constitution and it is considered the Court of Last Resort

      meaning that it's decisions are considered to be final. The Court also

      has Original Jurisdiction, the ability to 1st hear a case, example a

      state suing another state or a Foreign Dipliomat being sued by

      somebody and the Court has Appellate Jurisdiction, meaning the

      ability to rehear a case already decided by a lower court.

      However, the real power the Supreme Court has is it's ability to use

      JUDICIAL REVIEW. This power means that the court may declare

      any law or Presidential Action unconstitutional meaning to be illegal.

    John Marshall, the Chief Justice of the Supreme Court came up with

    this idea and 1st used the power of Judicial review in the case of

    Marbury v.Madison.
