Question:

What happens after one files for child support?

This would be in Texas. My husband missed 2 weeks of child support payments (we arranged this ourselves). I told him that if he misses one time I would turn him into the Attorney General Child Support department and have them deal with the situation. I got two letters in the mail from them today stating the case has been opened and where the office was located as to who in my city is in charge of it.

How will they notify him? Will a cop come to his mom's door or will he too get a letter?

Anyone know?

  1. I think someone will go and serve him papers for court

  2. He will have to be "served" with notice that a lawsuit has been filed.  This means a constable will likely bring him a copy of the petition and he will hand it to him.

You will receive notice that there is a court date, and will have to appear.  If he fails to appear then a judgment will be entered against him.

It can take several months, so be sure to keep track of the money he gives you during the meantime.

You will not be entitled to be paid twice, but you will be able to get support for back payments while the case is pending.

You should have started this when you first separated.

Why have you not filed for divorce?  Child support is part of a divorce proceeding, and it would be much easier to do without the attorney general's office involved.

You can get child support ordered immediately as part of your "temporary orders" while the divorce is pending, and a good lawyer will see to it that the husband pays the attorney fees if it is his fault you cannot remain married.

    Good Luck
