What happens durning investigation of sexual abuse?

How does the investigation process work? My son told me his butt was touched, I called police. Missing and explotied childrens unit picked up the case. NO CPS involvement at this point just police. The man my son accussed was arrested on this statement. Now my son is saying he didnt do anything. I myself called in a CPS report this weekend because I want to know if it happen or not. The police think I am tring to protect the person but i am NOT! I just want answers and no one will tell me anything.

  1. look make the guy take a polygraph if he passes let him go i have a nephew like this who lies all the time! he'll say someone touched him then ill say ok im calling the police then he goes well i think he was going to touch me.


  2. First, you can't "make" someone take a polygraph. Second, if it did not happen what a horrible thing to be arrested for and accused of. Does your son have a history of lying? Maybe talking to him yourself and getting  to the truth is appropriate. If the guy did it, I hope he gets what he deserves. NOTE: I am not allowed to describe what pedophiles deserve on this public board, but trust me it is special.

  3. There wouldn't be CPS because, I'm guessing, your son is still in your custody.  It's not like they're taking the kid away and putting him in foster care right?  Unless, of course, you're living with the man who got arrested.

    This is a huge problem in s*x cases, and I've done several.  Sure, there's the easy case where there is a grown man who has s*x with a child.  They get DNA, it's all over for the guy.  But then there's cases like this.  What was the relationship with the man?  Does the kid have ADHD or other emotional problems?  Does the kid have a motive to lie about the touching?  Does the kid have a motive to lie about there being no touching?  Do you?

    If this guy did touch a kid for sexual gratification, he needs prosecution.  But, I think everyone will agree, a case like this could be totally false and the guys life could be ruined simply because of the hysteria surrounding child molestation.  Jurors believe kids, cops believe kids, often it's right to do so, but sometimes the kid is just taking people for a ride.

    Example, I represented a guy with multiple felonies and misdemeanors, but he wasn't a sexual criminal.  He lived with his girlfriend who had a 17 year old son.  My client found out the 17 year old molested a 6 year old, so he called the cops.  The 17 year old then told police that my client molested him.  My client spent a year in custody before the DA finally dismissed the case.  Think about it.

    Also to clarify, a polygraph is admissible if the defendant and DA agree, which is rare.
