What happens if a commercial motor carier fails to pre employment drug test a new hire (DRIVER)?

ok this is a trucking company with full size dump trucks and tractor trailers

  1. The law does not require pre employment or random screenings by the employer if the employee has been tested by any governing agency within the last 180 days if the record of that test is attached to his employment application. The random tests are also suspended if previous employers submit negative test results from his or her time in their employment.

    But all the employers in Arizona that I know about have to have an initial Physical that is less than 90 days old for employment and the drug screen is done when physicals are done.


  2. If your truck is 26001 lbs or more then you need to comply with DOT. If not, you are safe. You are not required to test if the employee was in a substance abuse program in the prior 30 days.

  3. If you or your truck do not meet the (DOT) requirments set down then nothing will happen...............
