What happens if another vehicle runs into your car, but the other driver doesn't have insurance? Are you pretty much just screwed?

  1. They are responsible for your damage.  If you have collision coverage, you can start repairs but will have to pay the deductible amount.  Your insurance will attempt to collect the losses from the at fault driver, and will refund your deposit if they manage to get it back.

When it happened to me, the driver of the other car, didn't get any tickets or anything.  He just walked away.  My insurance took care of my car, and my payments didn't go up.  Good Luck with it.  Insurance people are tricky and will try to get out of paying anything (my opinion, from past experience).

  5. Nope! Hopefully you have insurance and have purchased the uninsured motorist protection coverage. This should protect you in the event you don't carry full coverage on your vehicle. You should contact your insurance company and see if you are covered under either one of the coverages mentioned above. If you only carried liability coverage and didn't have uninsured motorist protection then you will need to file the claim in small claims court against the person. You can hire an attorney to help or you can just go down and file the claim yourself. First off Nickole, most states that I'm aware of.. that driver (who is at fault) WILL get a ticket for no insurance and quite likely also for careless and reckless driving.   If that driver has no insurance, you will have his personal information from the police.  Find the best attorney you can and sue them for damages.  Sometimes we have to take responsibility when others do not.

    If you don't have those coverages, then I guess in a sense you are "screwed."

    If the other person is decent you can try to get them to pay for the damages. Chances are though, if they cannot afford to pay for insurance, they cannot afford to fix your car.

  11. you call your insurance company and file the claim.  if you have the correct correct coverage they will pay your damages and then go after the idiot who hit you for repayment.  let your company work for you, that's what you pay them for.  they have the resources you don't.
