What happens if a juvenile hits an adult and the adult strikes back?

  1. It depends on the rest of the situation.  But If I were walking through the park and some guy punches me and I kick his tail.  And it turns out he's only 15, he's still the one thats going to be charged with assault.

  3. Depends. Who is the dominant aggressor? If the juvenile hits the adult and the adult hits him back once in respons. Mutual combat regardless of age.

    If the juvenile strikes the adult, adult hits him, kicks him, throws him to the ground and stomps him. The adult is the dominant agressor and could be arrested.

    If the juvenile hits the adult with a shovel and the adult punches the juvenile.  Juvenile is the dominant agressor.

    Like I said it all depends on the situation. They could both be let go, both arrested, juvenile arrested, or adult arrested.

  5. Depends on the situation.  But if only appropriate force is used the adult should be fine.  If the kid pushes the adult and the adult in turn punches the kick and knocks him out than that is beyond excessive force and the adult will be in jail.

    It depends on the circumstances of the situation. They would look at why the juvenile hit the adult in the first place. In addition, many states have a "duty to retreat" clause, meaning if the adult could walk away, they should have.
