Question:

What happens if a minor is pulled over with an open container of alcohol in the car?

Now this didnt actually happen and wont happen Im just curious. If no one in the car has consumed any alcohol and not driving under the influence, what would be the penalty of just having unsealed containers of alcohol in the trunk or in the car? Can u get your license suspended and will it raise insurance?

  1. Open container is an offense in most state regardless of age but if a minor has an open container in car depending on the circumstances and officer ,the car can be impounded and the driver ge given a citation for open container which if anything would raise his or her insurance considerably. For a minor I do believe they suspend the license but not for a very long time.

    Just saw tiffany post and that sounds reasonable.


  2. if the minor was drinking and driving they would get a citation for under age drinking and a dui. the citation for underage drinking would NOT raise insurance however, the dui would raise insurance. now lets say the minor was not drinking driving, they would just recieve a citation for underage drinking and they would have to pay a fine and do some community service hours but insurance would not raise because its a citation not a charge.

  3. Depends upon the state. Here, open container of alcohol by a minor could (and usually would) result in the minor's driver license being "Revoked: Buy-Possession Alcohol".
