  1. An overstay of one day would cause you to be no longer eligible to use the VWP for the rest of your life. Therefore, an overstay of 13 days would have the same effect. Section 217(a) of the Act provides the eligibility requirements for the VWP.

    One part of section 217(a) stipulates that no one can use the program if they have previously violated any of its terms. By staying more than 90 days, you violated its terms and cannot use it again.

    Next time you want to enter the U.S., you will need a visa in a classification compatible with your purpose and intent.


  2. Don't overstay just go to INS and get an extension.

    Since you come under VWP, most probably you are from Europe, If you are white and from EU, you will get extension easily, otherwise you might have to give them a actual reason for staying more and might have to answer some difficult question leading to prove that you will not be involved in illegal activities and will leave when the time expires.

    But do not overstay under any conditions, it will make it nearly impossible to come back in again.

  3. If you overstay by 13 days you stand a very good chance of being taken into custody the next time you try to enter the United States.  You'll go into detention and processed for immediate removal.  

    You'll no longer be eligible for the Visa Waiver Program.

    There are NO extensions for VWP.  Not even if you are white and from Europe.  Only a B-2 tourist visa can be extended.
