What happens if someone skips out on probation?

Do they have to go back to jail if they get caught? Do they have to do MORE time? Do the people they stay with get in trouble of aiding and abetting? Do they have any rights at all?

  1. Yes. You will not be eligible for bond on a violation of probation. You will wait to go to court. If you have a really good reason and a good lawyer they may reinstate you..otherwise you will face jail time based on the crime and the sentencing guidlines even up to the maximum. That depends on the judge. It looks bad but again it depends you can get reinstatement,credit for time served and jail time, and definately no bond until you or whom you ask about violates. Generally if you know suggest the person turn themself in. That goes a long way with pleading for reinstatement or a lighter sentence when they eventually get caught and they 99 percent will. Generally if they get caught the police will only take that person into custody. If you have no charges and theirs are not serious..it's not likely you will be charged with a crime. trooper3  and pm are right.A warrant will be issued immediately.


  2. YES THEY DO. THEY WOULD MOST LIKELY HAVE TO MAX OUT THEIR TIME. AND IF THE PEOPLE KNOWINGLY HARBORED THE FUGITIVE. YES THEY CAN BE CHARGED. IF THEY ARE AN ALIEN THEY WOULD BE DEPORTED.

Probation is allowed in lieu of jail time.  If you do not complete your probation you can be sent to jail to complete your original sentence or given a jail sentence in lieu of probation time (by the original judge), and also charged with 'breach of probation' as a whole new charge.  If you help the person to skip out or hide them you would quite likely be charged with aiding and abetting.  In all cases the person skipping out would have a warrant issued for their arrest and it would likely be enforceable in other states, or if it happens in Canada then in other provinces  (not both).  Not at all worth it, I guarantee you.  Cheers!!

    Well, whats the reason why this person would be not attending probation meetings, contacting agent by phone, or by any other means?  

    Depending on the reason why, this person is an idiot like me and will have a chance to convince the courts why they SHOULD remain on probation and NOT do jail/prison time.  With drug addiction as my problem, I have been givin' 3 chances to stay sober, and remain law abiding with probation being reinstated after violating terms of probation.  

    The courts will 9 out of 10 times give you a chance to better your life if your are trying.  But skipping out of probation and hiding/running until caught... are not trying.  Trying is turning yourself in when s******g up, going to treatment when not staying sober, contacting agent no matter what!  

    As easy as it is to say...I am in similar boat.

    Except no warrant issued, I was violated for not being honest with agent, admitting to using drugs, and not remaining law abiding.

    I have my second court appearance oct. 8th for 3 violations on 3 files.  

    Ouch.  I think I am facing two hundred twenty some months...

    ...I am hoping to keep my head up, stay on the right path and be honest with the courts about my desire to stay sober.  Drugs are killing me and taking my life away.  Its too bad its taking so long to see that.  

  7. Most of the time they get a warrant issued then they stay in jail for the remainder of the probation.

    Probably just a coincidence, but I tried to find a probationer that just skipped out after seeing her agent a week ago.  Her name was Amanda too.

    The person she was staying with failed to report her missing for over a week, and misled her P.A. and will be facing charges.  The person when and if arrested will be facing the remainder of there time in jail.  

    All citizens have rights.  In order to violate your probation there will be a hearing where you will have counsel appointed.  You will be held until the hearing in jail but you will have the right to defend your actions.

    Contact your agent.  

  9. Any time you violate probation, you will have a warrant issued for your arrest, and you can be sent back to jail for the remainder of your probation.

    Your probation is put on hold from the time of the violation, so you can not "wait it out" and be safe.
