  1. The above answerers pretty much cover it. I just wanted to add that your liability insurance will greatly be reduced if you require that your staff have a background check (and FBI check as well). My center saved over $9000 just by requiring that their employees had the extra FBI check done as well as the basic background check.

  2. You should always have a criminal background check completed on your employees even if your state does not require an FBI background check to be on file.  In Alabama, an FBI background check is not required if your daycare or preschool is under the umbrella of a church.  Faith based daycares in Alabama have had problems with harboring employees with criminal offenses in their backgrounds. The applicants apply at the faith based facilities since they know that the center won't be running a check.  Do the right thing and require your employees to have a background check.  Maintain this policy because it's the ethical and moral thing to do. Do it for the children in your care.  You don't want some child abuser, spouse abuser, thief, drunk driver, or drug addict working in your center.   All these offenses will come up on a background check.

  3. A Criminal Records Bureau check is required to ensure the safety of the children in care.  You would have to find out from the child care licensing bureau what their penalties are.  They could range anywhere from a warning to immediate closure of a facility for non-compliance, or even official charges.

These checks are not only vital to the security and well-being of the children in care, but generally put parents at ease just knowing that these precautions are in place.

The point is, if you don't have one: get one.  If you have someone on staff who doesn't have one, file one.  The facility Director should have filing information available and the check should be a part of the hiring process.

I hope that answers your question (without sounding all scary).
