What happens if you're arrested while on probation?

Today my boyfriend was arrested for driving with a suspended license. He's on probation for larceny (I think)... or something along those lines. The guy at the jail told me he'll have to stay at least 10 to 14 days without bond. Is that true? Because he's the only source of income for us and our daughter. How can they deny him bond? Does anyone know about this sort of thing?

  1. He will be charged with violation of probation

    It will be tough to find a bondsman under those conditions

    being the supporter of your child may be his only chance depending on the mood of the judge


  2. He'll end up serving the remainder of his probation in jail..

  3. Driving without a license is a new charge. As such, he will be given a hearing in court, but even if he is granted bail for the current charge, he will still be held since he violated his probation.

    If you attend his hearing and the Judge grants bail, DO NOT PAY IT. You will be laying out cash for nothing. He has to be held until this current charge has been gone over not just in court, but by the probation  department.

    As noted above, when accepting probation in place of going to jail/prison, you sacrifice certain rights from being found guilty or pleading out. This is now considered post conviction and bail/bond rules do not apply.

  4. He will be in violation of his probation as well as facing new charges of driving with a suspended license. If he had not be on probation, my guess is he would have been released on his own.  

  5. Your boyfriend is an irresponsible individual.   Is it possible for you to find a job so you and your daughter can become completely independent of him?

    He's only going to make both your lives a whole lot more miserable as time goes on. Do you want your daughter to have a father like that?? Come to your senses girl!

  6. Probation is given instead of sending you to jail, kind of like a "chance" to prove yourself.  Since he violated it, he will have to do his sentance in jail.  

    You aren't sure why he's on  probation?  And you have a child with him.  Think about it.  

    Get a job and support yourself. Why is he the only source of income.  Surely you can get a job.   He is going no where.  For him to put you through this says he has little disregard for you and his child.  Don't even try to bail him out.  It wouldn't be worth it since he's going to go back in.
