What happens if you avoid being served court papers in TX?

I have a child support civil case with the Attorney General in Texas. The father of my child is avoiding being served. He has lived in 3 residences in the past year and the constable can’t track him down. I have his current address and gave the attorney general his new address. I tried calling the court and searching civil cases online. I feel so helpless. I don’t understand why they can’t locate him. I have been served and I was told to attend the court date even if he isn’t served. What will happen if he doesn’t get served by our court date? Does anyone have any suggestions on how I can help the constable track him down?

  1. Well, if the case is continued without him, there is a civil rights issue and any order you get against  him may be able to be overturned.

    as far as getting him served that is the job of the attorney general. unless you hire a private attorney to sue him for the child support, they will inturn involve the attorney general, then you can give them all the correct information.

    if you hire a private attorney you are entitled to sttorney fees in a reasonable amount.


  2. After 30 days and a reasonable attempt to locate him the case can continue without him. He can't contest any judgement against him.
