Maybe.  You don't buy "from" ebay; you buy "on" ebay.  They facilitate a deal between two private parties and take a cut from the one that's selling the item.  You did not buy the item from ebay.

As far as getting your money back that depends on how you paid, where you live, where the seller lives, how the package was shipped.  There  are a lot of ifs here.
