What happens if you get a summons for court but won't be able to go on the day?

This is for dangerous driving and is for the end of September. I'm in court for sentencing for GBH on 8th and have been told I'm getting a sentence so will be in prison when I'm meant to be in court. My solicitor isn't in the office until Monday.

  2. You get a warrant for your arrest, But seeing you will be in jail at the time, usually they will take you before the judge on your required court date.

  3. Tell the prison registration clerk when you arrive. I can't see why it's a big deal though. If you're in clink (quite justifiably, I would assume) then you're in the clink. But if there's good reason for you to appear in court then the prison service will arrange it all.

  4. The court's computer system should show that you have already been imprisoned by another court and they will then request for you to be produced by the Prison Service or appear by video link. If they can't get you on that day they will just adjourn it until you can be produced.  

  5. You could get a suspended sentence and be put on probation rather than prison.  Tell your atty Monday and he will take care of it.  Good Luck,.  I don't know what GBH stands for.

  6. The CPS can get a production order from the prison. They will need as much notice as possible for this. What it means is that you will be driven from the prison and held in custody in the court cells, returning in the prison van after sentence.

    You may choose to waive production to the court and let them get on with the matter of sentencing you in your absence if you are in prison for a long stretch. The main reason why courts insist on people being present when they are going to be disqualified from driving is so that there is no risk of their being on the roads claiming that they didn't know that they had been disqualified. If you are in prison it can be guaranteed that this won't happen.

    It is in your interests to be sentenced for the dangerous driving while you are a serving prisoner, as you can pay off the fine by serving extra days or alternatively serve a concurrent/consecutive prison sentence for the dangerous driving.

  9. what happens is this, you will be tried as not appearing in court, and a warrant will be put out for your arrest,then they will find out you are in jail,so when you come out of jail, the police will be waiting for you outside,and arrest you for not appearing, and you will go to court for not appearing,and probably sent back to jail to wait a new court appearance.  

  10. I believe you don't get in trouble for missing a court summons if you're already under lock and key. It's somewhat out of your hands.

  12. Leave a message for your solicitor. Ring the court. When you are taken into custody tell then you are due for a court appearance, they will either arrange for it to be postponed or the prison service will arrange for your to attend.

  15. When you go to Court for sentencing, you should advise your lawyer, the prosecutor or the judge of your future court date.  If your future court appearance is scheduled at the same court, they can address the charges on the new case at the time of your sentencing.
