My mom's attorney sent my brother and I papers saying that my mom filed a disclaimer and that my brother and I were now beneficiaries (sorry misspelled) and that we needed to sign the money over to our sister. Well my mom filed bankruptcy so we didn't want to get in trouble so we got an attorney. Well once our attorney stepped in they decided there would be no disclaimer and now my brother and I are wondering how can an attorney send us all these papers and get away with it ? We just wanted our attorney fees back and just maybe like no more then $2000.00 a piece for what we have gone through this has been going on for 7 months now we haven't even gotten a chance to grieve due to all of this thrown in our face. Someone please tell me is this all legal and can an attorney really send you fake papers?

how would a judge feel to see these papers? Please help me understand. I do have an attorney but I think there's something wrong with the whole picture.

  1. Attorneys have a duty to be truthful with the court and their clients. I have never heard of a "disclaimer" legal action and I would never see anyone be rewarded 2 grand for being "what they have been through" but I do see a refund of any fees paid if the attorney created false court papers in order to dupe a client.  In any event if you believe an attorney has acted unprofessionally, file a complaint with your state's bar association.  Fire the lawyer and ask for a copy of your file.  Then go to the courthouse and ask the clerk to see the court's file so you can compare what is officially filed versus what you were given.

  2. That attorney needs to be reported to the bar association and have his license revoked.
