if it is a first offense?

Is he likely to get off, get probation, and restitution?

I want him to learn a good hard lesson about stealing now before he is any older. Will it go away from his record at 18?

  1. You turned your own son over to the police? Now he has a police record and will never forgive you for this. EVER! This is how n**i Germany started. A police record can only hurt his life. As parents don't you think you could take care of your son with good parenting in the first place?

  2. oooh I love this. I supoose the laws vary from state to state. Just a guess but I would say probation. Of course you realize he is going to hate you, so ya might consider a restraining order (just kidding) This is amazing, God I love this-imagine that! A parent doing the right thing.

My hat is off to you.

  3. Your kid will probably hate you for a long time.

  4. Will depend on the state.

I'm from NY, so here goes.

Stealing a debit card is a felony - Grand Larceny, though 1st offenders can be sentenced to as little as no time, and are eligible to probation for 5 years.  Restitution can be made part of the plea offer, though it's not clear to me if it can be ordered if he's convicted after trial.

Since he's 17, he may be eligible for "Youthful Offender" Treatment - this means that his conviction will be treated as an "adjudication" and not count on his record.  It will be visible on his record (because there is a limit to how many you can get).  Under some circumstances, a YO is mandatory for a misdemeanor offense, but not for a felony.

  5. I know somebody who did that before and what happened was he got a probation but the thing is when the kid applied for college ( nursing ) there wasn't any way for him to go because of that misdeamor it totally ruined all his plan. Now he has to wait for 3 years until his probation is done and not only that pay lawyers $ 5000 just to expunged this misdeamor charge. There's a lot of other ways to teach your son a lesson.....help him find a job ...or talk to him..make him to do choirs to get gas money.... that way you both can also spend some time.... i  hope this help goodluck..

  6. Depends on the state you live in. Generally they should be charged with theft and if a first offense most likely will get probation.
