What happens if your paying Alimony/Spousal support and lose your job?

Just found out my company is going to lay me off. I am on year 2 of my 10 year Alimony payments based on my 90,000 salary. My skills are outdated and I know that even if I do find another job (I work in IT) I'll be lucky to get half what I'm making now. If that happens, will the court lower my alimony payment to my ex? She pays me child support because I have custody of the kids.

  1. after you get laid off and get a new job you will have to go to court to have your alimony reduced (personally i think alimony is stupid,  the judge ordered my ex pay me 1.00 per year just for principal)

    but as soon as you get laid off, go to court and have your child support raised.


  2. you need to alert your wife if you're on speaking terms and more importantly, go back to court to file a modification..they will probably ask for proof that your job is going to lay you off or that you've been laid off but they will make arrangements .  good luck

  4. you go to jail.  But seriously i would have to call the judge and tell them the situation. And after they take all of dignity and convince you that you are bomb they will give you some type of relief.  

  5. You can try to break even with your ex-wife. She pays child support and you pay her alimony. Just subtract the amount she pays you from what you pay her. You should also go to court and tell them about it; they may lower your payments.

  6. You will still owe unless you go back to court to get your payments reduced based on your current marketable skills. Unemployment is not a reason to reduce payments.Neither is underemployment (flipping burgers).  It should be based on how much money you are able to make while you are gainfully employed.
