What happens in a no-fault car insurance claim?

I was involved in a minor accident recently. I claimed it was the other party's fault. The other party claimed it was my fault. The police report assigned no fault to either party...

  1. For automobile insurance the most efficient way to get a fantastic rate is do a policy comparison on auto policies. Make certain that you choose similar options with the same limits, car model, location, etc so that all things are a good comparison.

  2. With No fault, your insurance company takes care of you.   I guess it averages out for the insurance company.  I had no fault in New Jersey, it eliminates a lot of court cases.

  3. The term NO-FAULT only applies to medical claims.  Some states have NO-FAULT so if a person gets injured, the medical bills will be paid immediately (by each driver for their own passenger).  But even so each hurt passenger can eventually sue the other driver (who might be at fault).

    The damage to the cars are alway fault (who ever did it pays for it).  If the police assigned fault, you can file a law suits but you might not win.

    P.S.  Some people below are writing that no-fault does NOT apply to medical.  True it can apply to pain and suffering, etc.  But not to the damage to the car.  See this article:

  5. basicaly NO FAULT means what it says. neither party is at fault. this is a law in the state of flordia as it is a no fault state.

    your insurance company will be responcable for your damage to your car and theirs will be responcible for their car.if the damage isnt greater than your deductable by 500.00 or more depending on how much  the deductable is then it wont be worth fixing it.... if your deductable is 1000.00 then the damage needs to be at least 1000.00-1500.00 dollars worth to make it worth your while.

    in any case its totally up to you to fix or not fix your car.

    if by chance you have a friend in the body work business maybe he can fix it for free.

  6. This is not considered a 'no fault' claim.  This is a fault dispute. If  both parties are insured it will go into arbitration, the insurance companies present their cases and a judge or mediator make the decision of fault.

    FYI, 'no fault' is not for medical claims!!

  8. Negative, some states and provinces have manditory no fault accidents unless it was a malicious act.

    Ontario has No fault insurance now, and I am not 100% sure on this, but I think if you get in a standard accident in a no fault situation, there is in fact no fault.  Your rates will only go up if you make a claim with your insurance company.

    You do not provide us with the details of the accident.  However, if your were both equally at fault, then it will be 50/50.  Somebody, if not both parties, has some liability.  You pretty much cannot have an accident with out 'fault'.

    As somebody else posted, No-Fault applies to the payment of medical bills under your PIP coverage assuming you live in a No-Fault state.  This is correct.
