What happens to the a US Citizen if they marry a undocumented person?

Would that citizen go to jail or get into trouble for marrying someone that is here illegally? Please give links if you have them to provide to back up your comments.

  1. They would have to hand in their membership card based on stupidity.  


  2. No.  Citizen will have no such problem, either the spouse.  Usually citizen will marry to this person, then file his/her greencard.  Once USCIS receives this document, his/her illegal staying will be waived.

  3. Nothing will happen to the citizen. We are free to marry whomever we want without penalty. If you plan on starting the process to get your spouse a green card, the spouse will have to go back to their country and will be banned to enter for about 5-10 years.. however there is a form you can send in to USCIS that will ask for them to pardon him and if approved he will be in his country for only 1-3 years or so.

    MARRIAGE TO A U.S. CITIZEN

    Spouses of U.S. citizens are considered "immediate relatives" and are exempt from all numerical quota limitations. In other words, the foreign spouse is granted U.S. residency as soon as the paperwork is processed; there is no further waiting period. Marriage to a permanent resident may involve a waiting period of several years for the foreign spouse to become a resident.

    If the foreign spouse is in the U.S., and/or if the U.S. citizen resides in the U.S., a petition with supporting documents is filed with the appropriate USCIS office. The USCIS will issue employment authorization and permission to travel outside the U.S. ("advance parole") to the foreign spouse. The next step is the marriage interview, which may take place anywhere from five months to twenty months.

  9. The worst that will happen is that the undocumented person can be sent back home if caught residing in the US illegally, they may also be given a 10 year ban from re-entering, breaking up the family.


  10. What?! Are you supposed to pay a penalty because you fell in love and get married? No,the citizen will not get in trouble at all. If the undocumented person came with a visa(which expired later), then the us citizen can help his/her spouse (the undocumented) adjust his status. On the other hand, if the illegal person came without inspection, (even though they are married), they can adjust the status because there is no status to adjust. In that case s/he needs to go back and come back legally.

The citizen will always have to worry about the illegal spouse being deported and if children are involved,there is a strong possibility that because of selfish,foolish actions they will be raised without one of their parents. Is that what you really want for yourself,are you up to supporting a household on your own?

    P.S. If the citizen marries just to keep the illegal in the country,they can go to jail.
