What happens when 2 ppl get into a car accident and have 2 totally different stories?

and there no evidence or witnesses to collerborate the story of either one of us? The cop was confused too so how can he write a report? First he said it was my fault then he says that it was her fault wtf??? So how will they determine who's fault it was? She hit me from behind so i thought that i was totally incident even though the cop insinuated that it might have been my fault, How the h**l can it be my fault when she crashed into me??

  2. You ask how it can be your fault but don't really describe what happen. So no one can answer that portion of your question.

    The insurance adjusters from both carriers should speak to both drivers and obtain a copy of the police report. Based on that information they will determine if the person filing the claim has met their burden of proof based on state laws. If not, they will deny the claim.

The best solution is to report the accident to both insurance companys.  The claims department will review each party statements, look at vehicles, review police report and try to determine what actually happened.  It a possibility that fault can be shared by both parties based on a percentage

    Just because she hit you doesnt automatically make her at fault. Why did she hit you? did you turn infront of her? did you make a sudden stop? did you pull out into her path? Please be specific.

    Anyways, The insurance companies will take statements from both drivers. If there were passengers, they will take statements from them as well. They will inspect both vehicles and match up the damages. They will be able to figure out what happened, and who is at fault.

Does it really matter who was at fault?  The damage will be paid by either (or both) of the insurance companies.  Report the accident to your insurance company and let them handle the entire matter.  They will determine best, whether to use your own insurance or go after the other party.  Use them, that is what you pay them for.
