What happens when a home is sold at court and there are tenants in the home?

I am the tenant and I fear that I'll be locked out ?

  1. In most states, tenancy ends with foreclosure.  Usually, the tenants will get notice to vacate the premises within 30 days.


  2. You would need to go through the eviction process. Usually, the sheriff would get to do this.

  3. Sold at court means there was a court-ordered sale (bankruptcy) or it was foreclosed by the bank because your landlords pocketed your rent money and didn't pay the mortgage.  If your lease was dated after the mortgage was put on ( it usually was) then you have to get out.  The sheriff will come and give you a deadline which will be very short.  Call the sheriff or constable today.

  4. if the house has been sold, and not to you, i would suggest finding a new place to move and fast.. they can and will lock you out unless the new owner wants to rent to you.. good luck..

You won't be locked out.  You're still a tenant and the new owner is required to treat you as same.  However, you will probably be asked to leave within thirty days, since that is the general requirement for removal of a tenant.  If you have a lease, it does not transfer to the new owner in an involuntary sale.

  6. Most often the home is purchased by an investor. Be a good tenant and they will probably keep you.

    Legally, they have a right to make you move, and if they do, you should do so voluntarily and avoid an eviction.

  7. it depends on your state law. In Va for example if you have recieved mail at a n address you have 90 days after you are served eviction notice. Ater that your pocessions can be put on the street and you will be removed by police. Check your local laws.
