What happens when a spouse gets a credit card in husbands name and doesn"t know?

I have a friend who is in the middle of a divorce and when I suggested he pull his credit report we found 3 credit cards that were obtained on-line totaling over $28,000. We got copies of when they were opened and the electronic information received. So what now? Please help

  1. Well if someone has obtained a credit card in someone elses name without their consent and kinowledge it is FRAUD.

    Pure and simple.

    Advise the comapnies concerned and report the matter to the Police.  


  2. Bad news. If they were married then he is liable, unless it's written into the divorce somewhere. It's unfortunate because it's fraud to open a card under someone else's name without their knowledge but people do it all the time and the CC companies only care about the money.

    He should talk to a good lawyer but i think he's on the line to pay it back.

  3. Your friend should already have an attorney, refer this to the attorney.  This is not a matter for anyone to handle on their own - do it right!  

    Outcome?  Generally someone is not liable for credit obtained in their name but without their consent.

  4. He needs to contact the companies who issued those cards and tell them he never authorized them. I'm not sure whether you mean he has a total of $28K credit limit on these cards, or whether charges have been made to them amounting to a $28K balance. If someone has been charging things on these cards that he never authorized, then he needs to file fraud charges against whoever is responsible. He should contact the bank or credit card company to investigate.
