What happens when a work Visa expires?

We have a friend who is in USA on a work Visa. For unknown reasons to us he let it expire and was just arrested on domestic violence (no charges were pressed). He's being held without bail, and has been told he will probably be deported. Court is Monday. Anything we can do to help him out?

  1. They will set a bail after the court hearing, If you pay he'll come out immediately. if you said you dont have money, they keep him for a few days more then they will release him. I know someone like that too.

    No one is going to bother to deport him. BTW, the guy I know lives in California. His family collects welfare.  


  2. He is a double criminal and an abuser and you want to help him out? how sick, the only thing you can do for him is pick him up at the airport or train station when they deport his deserving butt. Someone who is illegal and an abuser is not welcomed here!

    He should not be employed here, he was the one who made himself illegal and now he has to pay the piper. Hopefully he is deported quickly!

  3. His employment visa expired and was not renewed by the employer.  Therefore he is here illegally and must depart or be deported.

    Employment visas are not a path to citizenship. They are only temporary.  He had to leave immediately when he left his job or the visa expired, whichever came first.  There is no grace period to depart.  If he let a temporary visa lapse or stayed here after leaving his job, he knew he was violating the law.  There are no excuses for his behavior.  Now he is going to be deported and barred from re-entry.

    Do not try to "help" him or you risk legal problems yourself.  And there is nothing you or anyone can do to prevent his deportation.  Stay out of it.

  4. Hire an immigration lawyer, the case could be prolonged by filings. In that time you/he might find a sponsor.  

  5. If his authorized period of stay has expired, he is deportable pursuant to section 237(a)(1)(B) of the Act. If he is no longer working for the employer who petitioned for him, he is not maintaining status. If he is working for another employer, he is doing so without authorization.

    So, if he did continue with his work, as you said, that all by itself would get him into trouble.

    Looks like there are three strong reasons why he should be deported. Now he's in jail. It's up to the Immigration Judge now.

Looks like he Didn't "Take Care of his Bidness"....What happens when we do the same....Duh......Now he is our Country Illegally.  Without bail:  Another bad choice?  I appreciate your want to help your friend out....perhaps you need to step away and investigate all the circumstances you are fighting so hard for.

  7. A foolish mistake in letting the visa expire.  Sounds like he is on his way back home because he is now an illegal alien.
