What happens when being caught speeding over 100mph down the 5 in CA?

My brother, who's normally the safest and slowest driver in the world, got caught going a little over 100mph on the 5 freeway near Fresno. Now anyone who's driven down the 5 knows how easy it is to speed without knowing because it is so open and straight. I feel bad because he was only driving on the 5 to see my graduation up in the bay area. This is his first traffic violation ever, and some people scared me by saying he could get jail time. Is this true? What would happen?

  1. Was he arrested when he was stopped?

    If the citation is for reckless driving he could get jail time. More likely his license will be revoked or suspended for a year.

    If there was no property damage or injury to others as a first offense he is unlikely to go to jail.

Your brother wanted to play with dynamite...He was lucky that he only got a ticket...In spite of what the maps show, I-5 in the San Joaquin Valley is only 2 lanes each way between the 5/99 split at the bottom of the Grapevine and Stockton...That plus the unpredictability of fog and the ever present truck traffic make both the 5 and the 99  extremely hazardous to drive...The collisions that happen there are not usually of the fender-bender type.

    He will have a fine to pay and maybe some remedial study, but I hope that he takes this as a wake-up call...The one truism of speeding is that there is normally somebody going slower in front of you...On two lanes, that doesn't leave much room for moving around.

  4. Don't worry about it. I am serious. Tell your brother to look in the yellow pages for a lawyer who deals with traffic violations and contact them. Over the years, I have had several speeding tickets and I have always sent them to a lawyer and they have always been reduced to a non moving violation. It could cost him $200 or so (maybe more in CA). Chances are, he won't even have to go to court. The system sucks in that you can pay your way out of a traffic violation, but take advantage of it anyways.

    Whatever additional fees he will pay the lawyer will be saved in not having to pay excessive fines and increased insurance premiums for the next 3 years or so.

    Please don't anyone take this as my condoning speeding. I have been ticket free for almost 5 years now - seems I have lost my "need for speed" as I got older ;-)

  5. That all depends. It doesn't look like jail time, but he could get a hefty fine, and probably a suspended license. Being it's cali, and maybe his first offense, he will most likely get a fine. Nothing to worry about, I hope! Just make SURE he shows up at his court hearing!

  6. NO, I got caught speeding on I5 to San Francisco..  gave me a ticket for $195..  for doing 110 on a 70.  just pay it, you'll be fine.

    I would tell him to get a lawyer

    Laws in nc might be stiffer than they are there...

  8. in florida, if you're going over 20mph over the speed limit, it's an automatic court date.

    double the speed limit is a felony in most states,  so i guess his punishment will probably be somewhere between those two

  9. I'm SHOCKED that they did not arrest him and impound the car on the spot...

    In CA, and many other places, if you are caught going over 20mph over the speed limit they have the option to haul your butt in on the spot.

    Cali is known for their prick police... Truck drivers around the country know better then to EVER do anything in CA because you are pretty much S.O.L.

    First offense or not... He hopped right into the deep end.

    Hopefully they will allow him to take the class but if he mouths off to the judge then yes, he can go to jail.

    COME ON, that's the most ridiculous excuse on earth. 70 or 75 maybe, but not 100+

    Normally, someone going that fast would be arrested, and he's lucky or maybe he's B.S.ing you.
