What happens when you don't pay on a small claims case?

My friend didn't go to the first court date he was supposed to and they entered a judgment with out him. Through out the past six years he has been took to court and told to pay. It has been about two years since and he has not paid on this judgement. He was just served again today. What do they do in court? He doesn't make enough money for them to take anything. (seriously) I know there is a threshold for how much they have to leave you with-gross wages. Any serious help would be appreciated.

  1. Thats the problem with small claims they can bounce around for years. He needs to pay what he can afford, because he owes the money. I'm surprised the court did not order a garnish of wages by now.  


  2. Most likely this person will have his wages attached to pay the judgment.

    They can take up to 50% of your gross( before taxes) wages depending on what state or county law allows.

  3. this will be different in each state.  i tried to sue in small claims court and was told the court would enter a judgement for me, but it was up to me to collect.  they told me there was no agency that took care of this, so basically you got a paper saying yes he owes you the money.  i think small claims is different, i don't think they have to leave you anything, you are to order the judgement as handed down...i think.



  4.         what are they go'na do ?put a warrant out for his/her arrest . Some bounty hunter [if it's worth it] will hunt it down.. and they [] can garnish wages[b******s] .           if  aressested ; will have options, but not many  or stone to death

    Judge Judy:

    She will close court with a judgement on that person,  &   Nothing happens.......UNLESS........ that person who is SUPPOSE TO PAY, wins lottery or a law suit settlement or a car injury law suit, then that money, that that person owes, will come out of that,  otherwise, NOTHING HAPPENS.........  

  6. They send a little bitty guy names Vito over with a tiny baseball bat. He gets on a tiny stool and puts tiny dents in your kneecaps.
