What happens when you purchase a car and it is under recall and they refuse to take care of the problem?

I purchased a car last year in June and it caught on fire in September. The company said it was not there fault even though the car was on recall for the problem as to how it caught on fire. I have not been able to purchase another car so what should I do?

  1. i've never heard of a recall where they didn't take care of the problem. call your state attorney general he works for you


  2. Sounds like you need a lawyer .Try that section or call your state attorneys general.

  3. Deal directly with the manufacturer instead of the dealer where you purchased it, also get the official recall notice, maybe you can sue them but you will need proof of a recall

If there was a recall, it was a manufacturer recall.  You should likely have checked the recall list for the car, and gone to a dealer for the work, as the dealer shop is the only one that could have done the recall work.  If you bought it from a dealer for that make, you do have a possible action through the dealer supervision at the manufacturer.  If you bought it from any other dealer, large or small, you don't have a course of action unless it was in writing in the contract that all recalls were checked and performed.  However, your comprehensive insurance still covers your car, whether the recalls were done or not.  You would either have your car repaired, or you would receive a cheque for the write-off value of that vehicle.

  6. If you can prove the fire was caused by the problem under recall,   contact the manufacture's rep  at the district office.     If no luck there,  check with an attorney.

  7. apparently you bought a USED car. Recalls, as warranties, are original owners. You'll throw money away with a lawyer, and still have a broke vehicle. Tow it to a scrap yard, and take the money for a down payment on something else. DO THE MATH before you buy again!

  8. Call the manufacturer and explain the problem.  They will probably want to know the Dealership name and I'd make sure I gave them the name of the person who told you "NO"!  A recall is normally a safety issue and the Manufacturers always want to get those fixed.

    Then to no avail?  Call an attorney but do not let anyone have that car for any reason!!  You keep that car in your possession until you get an attorney involved and then turn it over to them.
