What happens with child support if you are in prison?

I pay child support to my ex and it is more or less up to date. I am being sentenced next month. What happens about the child support when I'm in prison?

  1. You will still owe it. If you can pay ahead of time it would make it easier for all of you. You could also file for a hearing to have the amount reduced because your income will be changing obviously. If you are only going for a short amount of time, say a month or so, I doubt it would be adjusted.

It depends on your state laws...you can ask  for a reduction in child support because you have had a change in income.  Either they will grant you relief of child support or they will make you pay it when you get out of prison plus interest. You should really check into it now before you go to prison...

  3. give up your job, start a business with nil income just before you're sentenced. anything will do, window cleaner etc, then lay out on a few tools that you need to do the job ie bucket and sponge, squeegee, cloths. then ask for a reassesment based on your income. obviously you will have a negative income because you are just starting a business and the outlay of tools can be offset against any (nil) income, but then amount you'll be assesd for will be low or nil. then whilst you are in prison it wont be adding up, nor will it be adding up when you're released and cant get a job cos of the record. act now. i would

Glad for you I checked your questions.  Child support will continue to accrue if you do nothing to interrupt it.  You can petition the agency that collects it to set aside your support while you are locked up.  You will be unemployed then and unable to pay, it gets reduced under the same circumstances out here, why should it be less while you are locked up?  Don't wait, arrearages build up fast, and you can get (and likely will) charged with non payment if you just let it build.  I've know a couple of guys who were arrested on their way out the gates.  Seriously.  Do not wait.

  5. It will add up. Maybe you have someone who can continue the payments. If you are in prison, the tab is running until you are again making money, then you get tapped by the Child support unit for every single penny you owe.
